Terms of Service

1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Apicary ("Apicary", "we", "us", or "our") governing your access to and use of the Apicary website, dashboard, mock API runtime, and related services (collectively, the "Service").
By creating an account, accessing the dashboard, or using any part of the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, "you" refers to both you individually and the organization.
2. Eligibility and accounts
You must be at least 16 years old, or the minimum age required to enter into a binding contract in your jurisdiction, to use the Service.
You are responsible for all activity that occurs under your account, including actions taken by anyone you allow to use your credentials or mock URLs. Keep your login method secure and notify us promptly at privacy@apicary.dev if you suspect unauthorized access.
You agree to provide accurate account information and to keep it up to date. We may suspend or terminate accounts that use false or misleading information.
One person or organization may not maintain more than one free account to circumvent plan limits unless we expressly permit it in writing.
3. The Service
Apicary is a cloud-based API mocking platform. You define mock HTTP endpoints in the dashboard, receive live URLs for development and testing, and inspect incoming request traffic through real-time and historical logs.
Current features include workspace management, static mock endpoint configuration (HTTP method, path, status code, JSON response body, headers, and optional response delay), public mock URLs, request logging, plan-based usage limits, and burst rate limiting.
Some features described on our website or roadmap - including OpenAPI import, dynamic/faker responses, custom domains, team workspaces, SSO, audit logs, and full self-serve billing - may be marked as "coming soon" or not yet available. We may add, change, or remove features at any time.
The Service is intended for development, testing, staging, and prototyping. It is not designed for production workloads, high-availability use cases, or handling regulated data unless you have made separate arrangements with us in writing.
4. Plans, limits, and billing
Apicary offers Free, Solo, and Team plan tiers. Each plan includes limits on workspaces, mock endpoints, and monthly matched requests, as shown on our pricing page and in your account dashboard. Current published limits are: Free - 1 workspace, 5 endpoints, 1,500 requests per month; Solo - 3 workspaces, 50 endpoints, 15,000 requests per month; Team - 10 workspaces, unlimited endpoints, 100,000 requests per month (shared across up to 5 team members).
Burst rate limits also apply: up to 60 requests per minute per workspace and up to 300 requests per minute per originating IP address. Exceeding monthly quotas or burst limits may result in HTTP 429 responses until the limit resets.
Free plan: the Service is provided at no charge, subject to these Terms and applicable limits.
Paid plans: Solo is priced at $10 per month and Team at $25 per month for up to 5 team members, unless otherwise stated on our pricing page. Paid billing is processed through Lemon Squeezy (or another payment provider we designate). By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis until you cancel.
Upgrades, downgrades, and cancellations: plan changes take effect according to the billing flow presented at checkout or in your account. If you downgrade, existing endpoints and workspaces may remain in place, but you may be unable to create new resources until you are within the limits of your new plan. We do not delete your content solely because of a downgrade unless you choose to remove it or these Terms require removal.
Taxes, refunds, and billing disputes are handled according to the payment provider's policies and applicable law. Contact us at privacy@apicary.dev if you believe a charge is incorrect.
We may change plan prices, limits, or features with reasonable notice. Price changes for paid subscriptions generally apply at the next renewal after notice, unless required otherwise by law.
5. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
Violate any applicable law, regulation, or third-party rights, including intellectual property, privacy, or data-protection rights.
Upload, configure, or transmit malware, exploits, spam, phishing content, or other harmful or deceptive material.
Use the Service to attack, probe, scan, or interfere with third-party systems, networks, or services without authorization.
Attempt to bypass, disable, or circumvent rate limits, authentication, access controls, or other technical protections.
Scrape, crawl, or programmatically access the dashboard at excessive volume, or use the Service in a way that degrades performance for other users.
Reverse engineer, decompile, or attempt to extract source code from the Service except where permitted by law.
Resell, sublicense, or provide the Service as a managed offering to third parties without our prior written consent.
Misrepresent your identity, impersonate others, or use the Service to harass, abuse, or harm others.
We may investigate violations and suspend or terminate access, remove content, or report activity to authorities where we believe it is necessary to protect the Service, our users, or the public.
6. Your content and data
"Your Content" means endpoint definitions, JSON response bodies, workspace names, descriptions, and any other material you submit to or configure through the Service, as well as HTTP requests sent to your mock URLs that are logged for your review.
You retain ownership of Your Content. You grant Apicary a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use Your Content solely as necessary to operate, secure, and improve the Service - including routing mock traffic, returning configured responses, writing request logs you choose to view, and enforcing plan limits.
You represent and warrant that you have all rights necessary to submit Your Content and that Your Content does not violate these Terms or applicable law.
Do not submit real production credentials, payment card numbers, government identifiers, health information, or other sensitive personal data of third parties to mock endpoints unless you have a lawful basis to do so and understand that such data may be stored in request logs as described in our Privacy Policy.
We may remove or disable content that violates these Terms or that we reasonably believe creates legal or security risk, without prior notice where urgent.
7. Public mock URLs
Each workspace receives a publicly reachable mock base URL based on its slug. Anyone who knows or discovers the URL may send HTTP requests to it. Those requests may be processed, counted against your quotas, and recorded in your workspace logs.
You are solely responsible for what you expose through mock URLs, who you share them with, and what data you or your testers send to them.
Apicary does not guarantee that mock URLs remain private, unguessable, or confidential. Workspace slugs are unique but not secret credentials. Treat mock URLs as development tools, not as authentication or access-control mechanisms.
8. Intellectual property
Apicary and its licensors own the Service, including the website, dashboard, software, branding, documentation, and all related intellectual property, except for Your Content.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal development and testing purposes.
You may not copy, modify, distribute, sell, or lease any part of the Service or included software except as expressly allowed by these Terms or by law.
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
9. Third-party services
The Service relies on third-party providers for authentication, hosting, databases, rate limiting, error monitoring, and payments. Your use of those features may also be subject to the third party's terms and privacy policies.
We are not responsible for third-party websites, tools, or services linked from the Service, and we do not endorse them.
OAuth sign-in through Google or GitHub is optional. Your relationship with those providers is governed by their own terms.
10. Availability, support, and changes
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, provider failures, and force majeure events may cause downtime.
During the MVP and early launch period, the Service is provided on an "as is" and "as available" basis with limited support, primarily via email at support@apicary.com.
We may modify, suspend, or discontinue any part of the Service at any time. Where practicable, we will provide reasonable notice of material changes that adversely affect paid subscribers.
We may impose additional technical limits - such as maximum request body size (currently 64 KB for logged bodies), maximum configured response delay, or storage caps - to protect platform stability.
11. Termination
You may stop using the Service at any time. You may delete individual workspaces from the dashboard, which permanently removes associated endpoints and request logs.
You may request full account deletion by contacting privacy@apicary.dev. We will process deletion requests within a reasonable period, subject to legal retention obligations and backup cycles described in our Privacy Policy.
We may suspend or terminate your access immediately if you materially breach these Terms, create security or legal risk, fail to pay applicable fees, or if we discontinue the Service.
Upon termination, your right to use the Service ends. Sections that by their nature should survive - including ownership, disclaimers, limitation of liability, indemnification, and dispute provisions - will continue to apply.
12. Disclaimers
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will meet your requirements, that mock responses will exactly match future production APIs, that logs will be complete or retained for any specific period except as stated in our Privacy Policy, or that defects will be corrected.
Some jurisdictions do not allow exclusion of certain warranties, so some of the above exclusions may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Apicary and its officers, directors, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service or these Terms, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) €100 if you are on a free plan or have not paid us in that period.
These limits apply to all causes of action, whether in contract, tort, negligence, strict liability, or otherwise.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or intentional misconduct, or for death or personal injury caused by negligence where such limitation is prohibited.
14. Indemnification
You will defend, indemnify, and hold harmless Apicary and its officers, directors, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) traffic sent to your mock URLs, including claims by third parties whose data was submitted to your endpoints.
We may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
15. Governing law and disputes
These Terms are governed by the laws applicable to Apicary as the operator of the Service, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
Before filing a formal legal claim, you agree to contact us at privacy@apicary.dev and attempt to resolve the dispute informally within 30 days.
If informal resolution fails, disputes will be brought in the courts or tribunals of competent jurisdiction where Apicary is established, unless applicable law grants you the right to bring claims in your country of residence as a consumer.
If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the "Last updated" date.
If changes are material, we will make reasonable efforts to notify you by email or through the dashboard before they take effect.
Your continued use of the Service after the effective date of updated Terms constitutes acceptance, except where further consent is required by law. If you do not agree to the updated Terms, you must stop using the Service.
17. General provisions
Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and Apicary regarding the Service and supersede prior agreements on the same subject.
Severability: if any provision is held invalid or unenforceable, the remaining provisions remain in effect.
No waiver: our failure to enforce a provision is not a waiver of our right to do so later.
Assignment: you may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure: we are not liable for delay or failure due to events beyond our reasonable control, including internet outages, hosting provider failures, natural disasters, labor disputes, or government actions.
